An RFE got generated on my wife's 485 application. Our company lawyer filed our 485 applications. Does anyone know who gets the RFE notice? Will it be the lawyers office or us?

1. You cannot file I-907 yourself with the USCIS to upgrade to Premium. It has to be done through your employer or Attorney.
2. However, it is legal for you, the beneficiary, to pay for it ($1000 fee), i.e., you can write a check that is payable to the "Department of homeland security".

Form I-907 is a fairly easy form to fill. Fill it out, get it signed by your employer, and send it to the service, on behalf of the employer.
If you know the receipt number of the H-1B application, it shouldn't take you more that 20 minutes to get it all out.

My H1B extension is pending with the VSC. I want to upgrade my H1B extension to a premium process by paying 1000 USD.

Now, my question is - Can I do it myself thru efile or regular way using form I-907? Or should it be done only thru the employer or attorney?

I am asking this because my attorney is charging a ridiculous attorney fees of 250 USD on top of 1000 USD for upgrading my case to a premium!

Please help.

I think those bills will only be related to toughening border security n patrol..

Most likely...

But if we have a coordinated campaign to target the senators with letters/web faxes...who know we might be able to get some interim relief as part of the border security bills.

We should atleast try to recapture the visa's lost since 2000.

I for one am sending letters to both my senators. I read in one of the posts that sending letters via snail mail is ideal, along with basic info about your I140.

There is an excellent template of such letter in one of the media campaign thread.

I agree ..I wonder what kind of effect will swine flu have ..it certainly gives the anti-immigrants a huge advantage (as predicted by pat buchanan) ...

Will this bill contain a merit based sytem? I know Obama was the the key author of a bill based upon merit based in 2007.


Has anyone of you come across any type of information which reflects on Merit based immigration system this year?

You will have to open a service request (SR) with USCIS after 30 days have passed. Once you open a SR , usually service center will people will call and confirm about the current status and in about 45 days from SR open date they will try resolve the issue. If 45 days have passed, then you will have to take an infopass appointment figure out. Hope this helps!

I have a 4 year college degree from the US and 5 years of experience. I would like to know when they say 5 years of progressive experience does also that include an increase in salary over the five years? My previous employer paid me 60kper anum but my new employer is paying me 55k per anum. There is drop in salary by 5 thousand. Will this affect my application. Please advise. Thanks much!

Hi everyone,

I'm thinking of going into graduate school next year under F-1 status, which presumably should last until the end of my program in 5-8 years. As many of us are painfully aware, students aren't allowed to work except on-campus or as part of approved OPT and CPT programs.

My question is: is it possible for me to take out a TN (NAFTA) visa during the summer of one of my years so that I can work? F-1 and TN are both non-dual intent, so is it possible?

May be it is worth it or may be not....In www.cnn.com there is a section (on the left hand side) asking what the democrats should do first. (They are basically asking our opinion)

I wrote down some items that I thought they should discuss, namely, in the area of legal immigration relief for EB categories.

We probably wont gain anything out of it; at the same time, it doesnt hurt to send them our opinion.

if 6 years completed without an LC/I-140, then if someone moves to H4, does LC+I_140 in say 5-6 months, can he/she come back to H1 (3 year extension?)

Hi Friends,

I work for Company A from the year 2003 on H1-B Visa and here is my details

Priority Date : Aug 2004 (EB3-I)
I-140 Approved date : Jan 2007
I-485 Filed date : July 2007
Currently using : H1-B (8 th year running)
EAD & AP : I have both EAD & AP but not using it at this stage.


Now i got an offer from Company B but they can accept only EAD or GC with Good salary and position. I am really tired of getting low salary with company A as they started taking advantage of me.

Now if i use EAD card to move to company B (by using AC21) and once i get a green card (don't know when ??) do i have to come back to company A and work for one or two years as GC is for future employment ? Is there any rule like this ?

I am also planning to have my personal attorney after moving to Company B to take care of AC 21 and other communications.

I am not sure Company A will allow me to move at this stage and i cannot waste my life with this company for a low salary so i want to move and make some progress in my life.

Have any of you moved like this and got GC ? Will there be any issues ?

Please advise.

Is there anyway we could include EB immigration relief in the Economic Stumilus Package announced by President Bush by bringing up creative pointers such as more greencards = more small businesses, more greencards = more home buyers, etcetera ? I see a faint chance here. With the urgency to kick start the economy, if we can get something on the bill, it will pass and will become a law fast.

Am I out of my mind or is this feasible.

I would suggest googling for the Indian consulate in your jurisdiction. Although most indian consul websites are confusing and really difficult, so good luck.

btw, if your daughter was born in India, but she is here with you, how did she enter USA without a passport.

Hello - I found this article (http://www.kirupa.com/blend_wpf/create_text_to_speech_pg5.htm)very helpful, but am having problems when I publish it on the web server (Windows 2003 IIS) - I get the same message - i.e. The type or namespace name 'SpeechSynthesizer' could not be found (are you missing a using directive or an assembly reference?) on the server in the Event Viewer. Is there special configuration or files required on the server before you can publish the speech to text files? Any help would be appreciated.

Hi Folks
My Labor was approved under EB2 as the job required a Master's Degree but the Lawyer by mistake filed my I140 under EB3 and was approved Oct 2006. The mistake was noticed in May 2007 when we were planning to file for I485. The lawyer refiled my I140 under premium processing on may 23 2007. I checked the status on line and the LUD is May 27 saying application was received. The lawyer told me that CIS is waiting for 'original labor notice' from the labor dept.

Its been 2 months now and I am getting worried.
Anyone who has been in similar circumstances or familiar with this situation pl help. :(
