Hi All,
I have an approved I-140 from an employer X. I-140 was approved 2 years ago. And last year I left X company and took a full time position. Since X is my frined he did not mind leaving his company at that time.
I applied for 485 in July as a future employee for X using that approved I-140. I got EAD and AP also.
Now we got into some money issues and he wants to revoke my I-140/I485?
Can he do that?
Please advice.

I had misdemenour with conviction.Got my H1B stamping in Chennai.
Make sure you check Yes in the colmn "Have you ever been arrested". Voluntarily present the case dismissal documents.
Make sure you go to the appointment as soon as you land, If they say they will need to look into the case(It will take 3 weeks). They will not give your passport back when this process of "Look into it" happens. So you cannot travel back to US when Consulate takes time.
If the Consular officer is satisfied with the documents you have presented to him. In my case i had to produce case dispositions. Misdemenour is not a "InAdmissible" Offense even if you are convicted. made it back with 3 year stamping "Jai Ho"

You are not subject to the cap. As you spent more than a year outside the US , you have the option of resetting your H1B clock (in other words ,apply for a H1 which would be valid for 6 years ,but would also be subject o the cap) or reviving your old H1B which would not be subject to the cap.
If you need a reference ,PLease refer to the AC21 provisions.
I have an old H1B visa with approval date December 19, 2000. I moved to US in Jan 2001 and spend only 2 months in USA in total. Stay outside USA from Mar 2001 until now.

Just wanted to find out if you were aware if it makes any difference as to where you get your receipt from-- with respect to making an appointment(location).
What I mean is, would it be OK to get receipt from a HDFC branch in Mumbai, if you were going to make an appointment with New Delhi Embassy ?
Any experiences..?

It is common to all consulates and Embassy, it can be used anywhere, it will be drawn in favour of US Embassy, New Delhi. HDFC bank will issue you what they have to give, so don't worry.

Assuming you meet the requirements for E visa status as an employee and not an owner of the company, this is a viable strategy.

Apologies for any inconvenience caused by this thread.
Does 1 require a UK Visa if they are travelling on British Airways? As i have my parents travelling from India to USA on British Airways(they have Multiple B1/B2 US Visa)..
Spoke to BA &they advised me to speak to UK Consulate.:(
Any info be helpful.

What are the dates for applying for H1 and the start date for H1?
I will be done with my OPT by June 2012, so when should i start my H1 filling and is there any way that i can extend my status?

I have filed for green card for my mother (all the required forms like I-130, I-485). My mom has an interview for the 29th of July. But unfortunately, due to her mom's demise and other family obligation like taking care of my dad she will not be able to come. Infact, she is not sure when she can come back. My question(s):
1) Can I withdraw my application for her green card (I-485, particularly)? So that I can file at a later date when things are in order.
2) If not, can I get postponement on the interview? and how far can we postpone it?
The questions arise because if we don't show up for the green card interview it is considered abandonment of the process, and can make it difficult (or maybe impossible) to get a green card in the future. If it wasn't for the family situation she would have been happy to be here.

My AP was approved while my wife's it was denied with reason "there is no pending I-485". My PD is 22 Nov 05 which is not yet current so I don't understand why they denied derivative spouses petition while mine was approved. We had an interview back in January and everything went on well there. Did anyone have similar issue? What are my options? I do not want to spend money and file for motion to reopen.

Recently we had been to India trip( Jan -Feb 2010), we also had expired H1 stampings but valid H1B.

Hi All...
My attorney filed my EAD (mailed) on August 28 this year and last Friday I saw the approval too on USCIS site. Today I decided to help one of my friends with his EAD so I decided to pull the attorney filed copy of my I-765, I noticed that attorney had mentioned "AOS" in Q:15 instead of H1B. I am on H1B and I have never used my EAD... so I am worried now and I don't know what are my options now... Would you please take few minutes of your precious time and help me with the options I may have now to correct this issue?

Matthew Oh is reporting that the USCIS is planning to deny EAD applications filed more than 120 days before expiry. Source is described as correspondence to AILA from the USCIS. Hmmm!
I thought I read somewhere on their website that we should apply 180 days before expiry.
